Trademark Registration in India

Your brand name, logo, or slogan is how customers recognize you. It sets you apart from your competitors. To make sure no one else can copy it or ride on your success, you need to register it as a trademark.
This guide breaks down exactly what a trademark is, why you need it, and how to get one in plain, simple terms.
Have you registered your Trademark yet?
What Exactly is a Trademark?
A trademark is a unique identity marker for your business. When you register it under the Indian Trade Marks Act, you get the sole legal right to use it.
You can trademark things like:
- Brand names or business names
- Logos and symbols
- Taglines or slogans
- Unique shapes or product packaging
- Specific sounds or color combinations that people associate only with you
Trademark vs. Copyright vs. Patent
People often mix these up, but they protect completely different things:
- Trademark: Protects your brand name, logo, or slogan (the things you market with).
- Copyright: Protects creative work like books, music, videos, photos, or website code.
- Patent: Protects new inventions, machines, or technical processes.
Why Should You Care About Registering?
- It’s your legal shield: If a competitor starts using a name that is identical or too similar to yours, you can legally force them to stop.
- It builds trust: Once registered, you can use the ® symbol. This shows customers and investors that you are a serious, established business.
- It’s a digital asset: A trademark can grow in value. You can sell it, license it to someone else for a fee, or use it to franchise your business.
- It protects you across India: Your rights apply nationwide, no matter which state you are based in.
Who Can Apply?
Anyone doing business can apply for a trademark. This includes:
- Solo business owners and freelancers
- Small businesses, startups, and MSMEs
- Large private or public companies
- E-commerce sellers selling on websites like Amazon or Flipkart
The 6 Steps to Register Your Trademark
The process takes time, but it is straightforward if you take it step by step.
Step 1: Pick a Distinctive Name
The golden rule is to choose something unique. Avoid generic words (like trying to register “Sweet Bakery” for a bakery) or names that sound almost identical to massive, existing brands. The more unique the name, the easier it is to protect.
Step 2: Do a Quick Search
Before you spend money on an application, check the official government trademark website to ensure no one else has already claimed the name. Look out for names that sound similar phonetically, even if they are spelled differently.
Step 3: Find Your Industry “Class”
Trademarks are divided into 45 different groups called classes.
- Classes 1 to 34 are for physical products (like clothes, food, or electronics).
- Classes 35 to 45 are for services (like software development, consulting, or retail shops).
- You need to pick the specific class that fits what your business actually does. If you do both, you can apply under multiple classes.
Step 4: Gather Your Documents
You will need a few standard items ready:
- Your ID and address proof.
- Business registration documents (if you have an MSME/Udyam certificate or Startup recognition, keep it ready—it slashes the government fee in half).
- A clean image of your logo (if you are trademarking a visual design).
- A signed Power of Attorney if you hire an expert or lawyer to handle the paperwork for you.
Step 5: Send in the Application
File the application online through the official Intellectual Property India portal. Once submitted, you will immediately get an application number. From this exact moment, you can start using the ™ symbol next to your brand name.
Step 6: Wait for Government Review and Approval
- The Examination: A government officer will review your application. If they find an issue or need clarity, they will send an “objection.” You have a short window to reply and explain why your brand is unique.
- The Public Journal: If the officer approves it, your brand name is published in a public journal for 4 months. This gives the public a chance to complain if they think you are copying them.
- Final Certificate: If no one objects during those 4 months, your trademark is approved! You receive a digital registration certificate and can finally switch from the ™ symbol to the ® symbol.
How Long Does it Last?
Once you get your certificate, your trademark is valid for 10 years. After 10 years, you just need to pay a renewal fee to keep it for another decade. You can keep renewing it forever.
FAQs
How much do you charge for a trademark application? We have two straightforward options depending on what you need:
- The Basic Application (₹2,499): This covers the standard filing fees and handling the paperwork to get your application submitted to the government.
- The Premium Research Application (₹5,000): This is the one we highly recommend if you want zero risks. Before we even touch the application, we do heavy background research. We dive deep into the registry to check for hidden phonetic matches, similar sounding names, or potential legal traps that could cause the government to reject your name later. It saves you time, money, and headaches down the road.
How long does the whole thing take? Expect the entire process to take anywhere from 12 to 18 months from start to finish. It takes time because the government has mandatory waiting windows built into the law (like keeping it open for 4 months just to see if anyone else wants to object).
